Whether the situation between the parties involved is amicable or contentious, an independent Chartered Surveyor’s report will help all involved in relation to the value of a home or investment property.

A valuation for matrimonial purposes aims to provide a Market Valuation, which can be used to decide how joint property assets are divided between parties involved in divorce proceedings.

We can carry out valuations for either party to make absolutely sure an impartial value is established through professional judgement. We also carry out valuations for mediators or directly for the Court.

Using Matrimonial Valuations

A Matrimonial Valuation Report will provide you with an accurate value of the property which you can then take forward with your separation proceedings.

The valuation can be undertaken on behalf of one of the parties, or alternatively, both parties can jointly instruct a Chartered Surveyor to undertake a valuation of the property.

Within our team we have RICS Registered Expert Witness Surveyors who have specialism in preparing reports for Court purposes.

Our Matrimonial Valuations not only comply with the rules and guidelines of the RICS Red Book, if required, they can also be undertaken in accordance with complying with part 35 of the Civil Procedure Rules (CPR) 1998.

Most frequent questions and answers

The surveyor will inspect the property, look at its key components and measure room sizes. They will consider the position of the property, its outlook, local environment and external features. The general condition of the property will be considered but this is not a detailed condition survey so assumptions will be made for the purpose of the valuation report based on what is clearly apparent at the day of the visit.

We report at the Valuation Date only (usually the inspection date but can be an earlier date if the parties require). It is usual for parties to consider this valid for perhaps 3 months but much depends on the wider market. If there are changes to property values then we can re-report on a Desktop basis. There is a charge for this service.

The Valuation will be undertaken in accordance with the RICS Valuation – Global Standards (‘Red Book Global’).

Market Value is defined as: ‘The estimated amount for which an asset or liability should exchange on the valuation date between a willing buyer and a willing seller in an arm’s length transaction, after proper marketing and where the parties had each acted knowledgably, prudently and without compulsion.’

The surveyor will seek comparative evidence and we will outline at least three examples of these within the report. The valuer will appraise comparables and make adjustment for the different features of those compared to the subject property to formulate a reasoning base for the valuation adopted.

You may be better to jointly instruct us Single Joint Experts from the outset rather than informal matrimonial instructions if you think lengthy court proceedings are imminent. Our RICS Registered Valuer who will also be a RICS Registered Expert Witness will provide a Court compliant valuation report. Please note, Court Reports are priced differently than informal matrimonial valuations.
